Fallout 76’s troubled launch continues as it has emerged that Power Armor Edition owners did not get the bag that was originally advertised. In order to fix the problem, Bethesda offered to compensate people that bought the special edition by giving them 500 atoms. People did not like this at all as the Fallout 76 Power Armor Edition costs $200 and the bag was supposed to be the second-most expensive item in the collector’s edition.
Players pointed out that 500 atoms are worth $5 and that the currency could even be farmed in-game without spending any money at all. Bethesda is also facing a lawsuit for the Fallout 76 Power Armor Edition bag and it seems that the company is now willing to replace the bag. According to the Bethesda Support Twitter account:
“We are finalizing manufacturing plans for replacement canvas bags for the Fallout 76: Power Armor Edition. If you purchased the CE, please visit https://beth.games/2QDropM and submit a ticket by Jan. 31, 2019. We’ll arrange to send you a replacement as soon as the bags are ready.”
This was bound to happen but it goes to show that Bethesda was not willing to do anything until it was at risk of being sued. It also does not mean that the company is in the clear, it is more than likely that Bethesda will lose the case even after it replaces these bags. US law states the following in such a case:
- Express warranties by the seller are created as follows: … (b) Any description of the goods which is made part of the basis of the bargain creates an express warranty that the goods shall conform to the description.
- It is not necessary to the creation of an express warranty that the seller use formal words such as “warrant” or “guarantee” or that he have a specific intention to make a warranty, but an affirmation merely of the value of the goods or a statement purporting to be merely the seller’s opinion or commendation of the goods does not create a warranty.
